While the filing of a personal injury claim officially initiates the legal process, not every claim will necessarily go to trial. It is the goal of every personal injury attorney to maximize the amount of monetary compensation his or her client receives. Whether this is accomplished through litigation or through settlement depends on the circumstances of each case. Taking a claim to court is inherently expensive. If a client stands to make more money by agreeing to a settlement out of court, it makes financial sense to do so. While some personal injury claims do go to trial, most are settled outside of the courtroom. Often, this is accomplished through careful negotiation with the insurance provider for the “at-fault” party.
